1. Acceptance of Terms

By accessing or using YFX ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users regardless of location, including users in the United States and internationally.

2. Service Description

YFX provides AI-powered image generation services. Users can create images by providing text prompts. The Service includes both free and paid tiers with varying features and usage limits.

3. Ownership of Generated Content

You own the images you generate. Subject to compliance with these Terms, all images created through your use of the Service belong to you. You may use, modify, distribute, and commercialize your generated images without restriction.

You grant YFX a limited, non-exclusive license to store and process your prompts and generated images solely for the purpose of providing and improving the Service.

4. Prohibited Uses

You agree not to use the Service to create, upload, or distribute content that:

  • Is illegal under applicable law in your jurisdiction or the United States
  • Depicts child sexual abuse material (CSAM) or the exploitation of minors
  • Contains non-consensual intimate imagery of real individuals
  • Promotes terrorism, violence, or harm against individuals or groups
  • Constitutes harassment, hate speech, or discrimination
  • Infringes on intellectual property rights of others
  • Impersonates real individuals for deceptive purposes
  • Creates fraudulent or deceptive content intended to mislead

Violation of these prohibitions will result in immediate account termination and may be reported to appropriate authorities. We reserve the right to remove content and ban users at our sole discretion.

5. Account and Credits

You are responsible for maintaining the security of your account credentials. Credits purchased are non-refundable once used. Unused credits do not expire for Pay As You Go purchases. Subscription credits may expire at the end of each billing period as specified in your plan.

6. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service interruptions.

7. Limitation of Liability

To the maximum extent permitted by law, YFX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless YFX and its operators from any claims, damages, or expenses arising from your use of the Service, your generated content, or your violation of these Terms.

9. Modifications to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will make reasonable efforts to notify users of significant changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
